AUTHORITY/SCOPE:
-
Pursuant
to the current constitution for the Western Cherokee Nation, this
directive shall have the full force of law and the effect of law,
immediately upon said directive's final codification through a
majority vote of the Tribal Council and the affixing of the mark of
the Principal Chief and the Great Seal of the Western Cherokee
Nation. This directive shall apply to all Citizens and to all
subordinate entities of the Western Cherokee Nation.
PURPOSE:
To
facilitate and direct the specific compliance with applicable
Missouri State Statutes and Federal Statutes & Regulations in the
structure, actions and business of the Missouri non-profit
corporation, WESTERN CHEROKEE.
DIRECTIVE:
-
It is hereby ordered and directed
that the Missouri non-profit corporation, WESTERN CHEROKEE, shall
immediately and upon this very day comply in full with the by-laws as
amended and as duly filed and recorded with the Office of the Secretary
of State for the State of Missouri.

Any tribal citizen that is compelled
by this directive and/or by the duly filed and recorded by-laws of and
for the aforementioned corporation to remove him or her self as an
officer or as a member of the Board of Directors of the aforementioned
corporation shall immediately surrender all real property, all
documents and all and any thing or things that are the property of said
corporation.

The Chairperson of the
aforementioned corporate body shall cause the answer to and the
notification of the Internal Revenue Service of this action so as to
notify that agency of said corporation's compliance with the pertaining
statutes.

The Chairperson of the
aforementioned corporate body shall cause the proper filing of the
appropriate documents that does accurately delineate the Officers and
the Board of Directors of the aforementioned corporation as of this
date with the Office of the Secretary of State for the State of
Missouri no later than Friday, 16 November, 2007. Funds are hereby
allocated for the fees required by the Office of the Secretary of State
for filing the afore described documents; a sum not to exceed fifty
dollars ($50.00).
PENALTY
-
The penalty or penalties for any
failure to comply with this directive shall be as the Elders Board
Judiciary Body may so direct.
ENFORCEMENT:
-
The Executive Department shall cause
the enforcement of this directive.

We,
the undersigned councilpersons, do on this, the 10th day
of November, 2007 hereby vote in favor of this directive and forward
same to the Principal Chief for his signing same into law; to wit:
